Terms & Conditions of Sale — Clare Timber Products

 

1. Definitions

  • We/Us/Our: the seller named above.
  • You/Your: the customer purchasing goods (consumer or business).
  • Goods: dried timber products (e.g., kiln‑dried logs, air‑dried logs, kindling, briquettes) and accessories.
  • Working day: Monday to Friday, excluding public holidays in Ireland.

2. Scope

These terms govern all sales of Goods in Ireland via our website, phone, email, or in person. Additional written terms (e.g., quotations) form part of the contract. If you are a consumer, you also benefit from mandatory statutory rights which prevail in case of conflict.

3. Orders & Contract Formation

3.1. Your order is an offer to buy. We accept when we issue an order confirmation or deliver the Goods, forming the contract.
3.2. We may refuse an order (e.g., where Goods are unavailable, pricing errors, or delivery limitations). Any sums paid will be refunded if we do not accept your order.

4. Prices, Taxes & Changes

4.1. Prices are in euro and include VAT unless stated otherwise.
4.2. We may change prices at any time before acceptance. Obvious pricing errors are not binding.
4.3. Delivery/collection fees are shown at checkout or quoted in advance.

5. Payment

5.1. Payment is due at order unless we agree otherwise.
5.2. For trade accounts, payment terms are as agreed in writing; late payment interest and recovery costs may apply under the European Communities (Late Payment in Commercial Transactions) Regulations.
5.3. Title/ownership passes only when we receive cleared funds in full (see Retention of Title, clause 10).

6. Delivery & Access

6.1. We deliver kerbside or to the nearest safe point with suitable access. You are responsible for ensuring adequate access and a safe drop area.
6.2. Delivery dates/times are estimates. We are not liable for delays beyond our reasonable control (see Force Majeure, clause 16).
6.3. If delivery fails due to incorrect address, unsafe site, or no one present to accept where required, we may charge a redelivery fee.
6.4. Risk of loss/damage passes to you on delivery or collection.

7. Inspection on Delivery

7.1. Please inspect Goods on delivery. Note any visible damage or shortages on the driver’s docket/photos where possible.
7.2. Report shortages/damage within 48 hours with order number and photos so we can put things right.

8. Product Quality, Moisture & Regulatory Compliance

8.1. Timber is a natural product; colour, grain and minor dimensional variations are normal.
8.2. We supply dried timber in line with applicable Irish Solid Fuel Regulations. Where required (e.g., wood supplied in units ≤ 2m³), moisture content will not exceed 20% (wet basis) from 1 September 2025 onward. Where larger volumes are supplied (>2m³), we provide storage/seasoning guidance with the Goods.
8.3. Our kiln‑dried target is typically ≤18% moisture; our air‑dried product is supplied to meet the relevant legal limit and product specification.
8.4. If you believe moisture exceeds the stated specification, we may arrange an on‑site measurement using a calibrated meter on a representative sample. If confirmed above the applicable threshold, you may choose a like‑for‑like exchange or a full refund, and we cover reasonable collection/call‑out charges. If readings are within specification, call‑out and transport charges apply.
8.5. Claims may be rejected if Goods were not stored correctly (elevated off the ground, well‑ventilated, protected from weather) or if logs have been used in a way that affects moisture.

9. Returns, Exchanges & Cancellations

9.1. Change‑of‑mind (conforming goods)

If Goods are within moisture parameters and free from defects, you may return subject to: (i) charges for any used logs (only unopened/unused items are credited), and (ii) transport/collection fees. Refunds are issued after inspection to the original payment method.

9.2. Size exchanges

You may exchange for a larger/smaller size subject to stock. Delivery/collection fees apply. If the new size has a different price, we will charge/refund the difference. If we delivered the wrong size in error, we correct it at no cost to you.

9.3. Faulty or damaged

If Goods arrive damaged or develop a fault, contact us within 48 hours (or within a reasonable time if the fault appears later). We will arrange repair, replacement, or refund as appropriate once inspected. Your statutory rights are unaffected.

9.4. Distance and off‑premises contracts (consumers)

If you are a consumer buying online/phone, you may have a 14‑day right to cancel from delivery of Goods (exceptions apply, e.g., made‑to‑order or cut‑to‑size products). You must return Goods within 14 days of cancellation in resaleable condition; you bear return costs unless we agree otherwise or the Goods are faulty. We may deduct for any diminished value caused by unnecessary handling.

10. Retention of Title

Ownership remains with us until we receive payment in full. Until then, you must store Goods safely, unencumbered, and separate from other property where practicable. We may recover unpaid Goods.

11. Safety & Use

11.1. Burn only in suitable, well‑maintained appliances per the manufacturer’s instructions and local regulations. Ensure adequate ventilation and safe storage.
11.2. Do not use wet or chemically treated wood in stoves/open fires. Keep fuels away from ignition sources and children.

12. Warranties & Liability

12.1. Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or other liability which cannot be limited by law.
12.2. Subject to 12.1 and your statutory rights, we are not liable for: (a) indirect or consequential losses; (b) loss of profit or business; and (c) any loss arising from improper storage/use of the Goods.
12.3. For business customers, our aggregate liability for any claim arising from a sale of Goods is limited to the price paid for those Goods.

13. Timber‑Specific Notes

13.1. Logs are sold by volume (e.g., crate/bag size) or weight as stated. Settling may occur in transit.
13.2. Natural cracking/splitting (checking) may occur as timber continues to season; this is not a defect.
13.3. Moisture readings can vary by log/section; we assess a representative sample.

14. Pallets, Crates & Packaging

Returnable pallets/crates remain our property and may be charged if not returned when agreed. Packaging should be recycled where facilities exist.

15. Data Protection

We process personal data in line with our Privacy Policy [link] and applicable data protection law (GDPR and the Data Protection Act 2018). Please review our Privacy Policy for details on purposes, legal bases, retention and your rights.

16. Force Majeure

We are not responsible for delay or failure caused by events beyond our reasonable control (e.g., extreme weather, strikes, epidemics, transport failures). We will take reasonable steps to minimise the effects and perform as soon as reasonably possible.

17. Complaints

We aim to resolve complaints quickly. Contact [claretimberproducts@gmail.com] or [0871145530]. If we cannot resolve a consumer complaint, you may have access to alternative dispute resolution (ADR) mechanisms where available under Irish law. (Note: the EU ODR platform has been discontinued.)

18. Governing Law & Jurisdiction

These terms are governed by the laws of Ireland. The courts of Ireland have exclusive jurisdiction, subject to mandatory consumer protections.

19. Changes to These Terms

We may update these terms from time to time. The version in force at the time of your order applies to that order.


Annex A — How to Request a Return or Exchange (Summary)

  3. Await instructions: we’ll issue an RMA/reference and collection/drop‑off guidance.
  4. Prepare goods: keep unused where possible; re‑pack securely; stack/strap for safe collection.
  5. Fees: transport applies for change‑of‑mind; not charged where we are at fault (e.g., wrong size, non‑conforming moisture).
  6. Outcome: exchange or refund after inspection in line with these terms.
